By operating an account with WOWX you agree to the following:

1.) WOWX reserves the right to refuse service, or cancel existing accounts without reason or warning. In the event of non-payment, any breach of this agreement or for any other reason within the sole discretion of WOWX, WOWX has the right to immediately, without need for notice, terminate client's hosting account. In the event of an immediate account cancellation, by WOWX or the customer, WOWX will not issue a refund.

2.) WOWX reserves the right to change fees, surcharges, or institute new fees at any time (however fees are guaranteed through your billing period). Chargebacks will result in a $25.00 fee added to your account and will be subject to collections if left unpaid.

3.) WOWX is not responsible for lost revenue, traffic, etc caused by server down time.

4.) Customers of WOWX are forbidden to partake in an "abusive practice."
The following is a list of current abusive practices. Participating in an abusive practice will lead to an immediate account termination without prior notice or refund on any pre-payment. WOWX reserves the right to add to or modify this list at any time:

•Hosting or having adult-oriented sites (including, but not limited to, linking to other adult sites, hosting adult content on your own site, and advocating adult material).

•Sending "bulk e-mail" (Mass Mailings), or USENET Spamming with your account.

•Allowing usage of our resources for accounts hosted on other servers. A web site not hosted with WOWX could not use its account to reference graphics, midi, cgi, etc. from our server without consent of WOWX.

•Using your account to provide cgi hosting services to large quantities of people on the web.

•Uploading, posting or reproducing in any way materials protected by copyright without the permission of the copyright holder.


Note: We believe in freedom of speech and expression, however, we will not risk a law suit or bad publicity for our company by hosting any "questionable material." Examples include but are not limited to:


•Any site advocating any illegal activities.
•Sites with a use of adult or profane language.
•Adult or ethnic humor sites.
•Any site bashing, putting down, etc. another cultural, religious, or ethnic group.
•Certain radical or cult style groups.
•Any site specifically slandering another person or organization.
•Any material determined questionable by WOWX.

5.) Customers of WOWX hereby understand that all information transferred over the WOWX site (which may include email and computer information) is subject to periodic review. Customers hereby waive all rights to privacy and allow WOWX to do what they will with said information.

6.) Customers of WOWX are bound to all of our policies A violation of any of these system policies will result in an account cancellation without refund.

7.) Account Cancellations:  In the event that the customer decides to terminate service with WOWX, a 20 day prior written notice before being invoiced will be required. Otherwise the invoice is deemed valid.

8.) This agreement is not assignable or transferable without the express written consent of WOWX.

9.) WOWX's hosting services may only be used for lawful purposes. Transmission of any material in violation of any U.S. or any State's regulation is prohibited. This includes but is not limited to: copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret. The client specifically agrees to indemnify and hold WOWX harmless from any claims resulting from a breach of these terms, and/or their use of the service, which damages another.

10.) The agreement constitutes the entire agreement between the parties hereto. The terms and conditions of this agreement shall be interpreted and enforced pursuant to the laws of the State of Washington.
